Agreement to Terms

By accessing or using KidsDaily's mobile applications, web portal, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

1. Eligibility

1.1 Age Requirements

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you meet this requirement.

1.2 Parental Status

To access child-related features as a parent/guardian, you must be the legal parent or guardian of the child(ren) associated with your account, or have legal authorization to access such information.

2. Account Registration

2.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access

2.2 Account Security

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3. Description of Service

KidsDaily provides:

  • Attendance Tracking: Digital check-in/check-out with verification
  • Daily Reports: Activity summaries sent from childcare staff to parents
  • Notifications: Push notifications for important updates
  • Absence Reporting: Tools for parents to report and track absences
  • Communication: Secure messaging between parents and providers

4. Acceptable Use

4.1 Permitted Uses

You may use the Service only for its intended purpose: facilitating communication and record-keeping between childcare providers and families.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Access accounts or data belonging to others without authorization
  • Attempt to circumvent security measures
  • Upload malicious code or interfere with Service operation
  • Impersonate any person or entity
  • Share login credentials with unauthorized persons

5. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13.

6. Disclaimers

6.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

6.2 Not a Substitute

THE SERVICE IS A COMMUNICATION AND RECORD-KEEPING TOOL. IT IS NOT A SUBSTITUTE FOR: direct supervision of children, in-person communication with childcare providers, professional childcare judgment, or emergency services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDSDAILY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, OR GOODWILL, SERVICE INTERRUPTIONS OR DATA LOSS.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the greater of: the amount you paid us in the 12 months preceding the claim, or $100 USD.

9.2 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.
